Navigating Special Needs Searches: Balancing Law Enforcement and Privacy

Abstract

[Name] Samaha (284) argues that special needs do not mean that the searches are entirely unrelated to law enforcement. On the contrary, special needs can result in criminal prosecution and conviction and are not directed to criminal suspects and defendants specifically but generally at people. Special need searches do not require warrants or probable cause and reasonably depend on balancing special government needs against invasions of individual privacy. In our case scenario, there is a special need to investigate the grandmother's whereabouts. However, the officers come along with some illegal drugs during the search. The law supports the seizure of items found during special need searches to help as evidence supporting the investigated case. Following such a move, it is clear that officers can open a case for the guy living with the grandmother based on the found and seized physical evidence (baggie of cocaine), which justifies the search in the first place. Yes, the police have the right to enter the house without a search warrant, as this is among the primary characteristics of the special needs search (pg, 284). The officer suspected the grandmother might have experienced challenges which hindered her from getting out of the house and engaging in her daily chore, as the neighbor narrates. To this effect, the officer employed the powers vested on special need searches and made a move to allow for a thorough search inside the grandmothers' house to get the right answers for their assumptions. Unfortunately, as anticipated, the special need search involved evidence of crimes (bag of cocaine), giving the officers a reason to further their search.
