Abstract
The issue between Mary and Janice is complicated, with legal and ethical implications. In preparation for an appearance on a home improvement program, Janice asked Mary, a wallpaper artist, to install pricey bespoke wallpaper with an elaborate design for her summerhouse. Janice canceled her presentation and, as a result, the wallpaper installation after Mary agreed to the project. This paper investigates whether Mary has a case for reimbursement, the legal theory that may back her up, and the ethical factors at work. Does Mary have a case for reimbursement? Mary may have a strong case for repayment, but only if she has a contract. Certain criteria must be completed in order to establish a breach of contract claim: Existence of a Contract: When Janice ordered the custom wallpaper and agreed to pay for it, Mary and Janice may have entered into a contract. Mary's actions in ordering the wallpaper and scheduling time for the job indicate a desire to get into a formal arrangement. Breach of Contract: If a genuine contract is established, Janice's choice to cancel the wallpaper order and the accompanying job might be interpreted as a breach of contract. This violation may entitle Mary to monetary compensation. Under what legal theory might she prevail and what are her damages, if any? In this case, Mary's conceivable legal basis for victory is "Breach of Contract." If a court rules that a genuine contract was created, Mary may seek compensation for losses incurred as a result of Janice's cancellation. These losses might include: Wallpaper Cost: If the personalized wallpaper is non-returnable, Mary might sue for $5000 in damages. Labor Costs: Given that she blocked off her calendar for this activity, Mary may be entitled to reimbursement for the effort she expected to put in placing the wallpaper. Lost Profits:...
