CRJU 412 [Name] Case Summary Report: The D.C. Sniper Case of 2002 Identify the subject and victims involved The D.C. sniper case also referred to as the Beltway sniper attack is a criminal case that dates back in October 2002. This sniper attack happened within a span of three weeks through a series of well coordinated shooting throughout Washington Metropolitan area including District of [City, State] and Virginia. The main subjects involved in this case were John Allen Muhammad (Aged 41 years at the time of the attack) and Lee Boyd Malvo (Aged 17 at the time) (Koen and Jackson, 2018). The two subjects were responsible of a series of shooting that claimed ten lives and left several others injured. It is clear that the victims in this case were randomly targeted individuals that included men, women and children engaging with their daily chores/lives. It is an attack that caused widespread panic and fear in the said region from Wednesday the 2nd day of October 2002 until the 24th day of the same month when the two subjects were handed over to the State police. Discuss pertinent information about the case The D.C. Sniper criminal case proved a series of well coordinated shooting that started some few minutes after 6 P.M. that fateful Wednesday, October 2nd 2002. A fifty five year old James Martin drove into the parking lot of the Shoppers Food Warehouse at 2201 Randolph Road at around 6.02 P.M. while on his way home from work and while walking towards the entrance one of the case subject shot him and fell face down (Censer, 2010). Since that day, the subjects took down other nine lives and injured three people while their random shootings inflicted fear and tension throughout Washington, D.C. metropolitan area for a period of three weeks. It is a case that stands out as among the most notorious with troubling instances of random violent acts in the American history. The case had two main perpetrators: John Allen Mohammad and Lee Boyd Malvo. At the time of the attacks, Muhammad was an adult male aged 41 years while his counterpart was a minor of 17 years. Boyd was a vulnerable teenager that was manipulated into this evil practice by Muhammad who served as the mastermind behind the attacks (Herberman et al., 2016). The timeline of the attacks was less than a month though their impact remains well defined in the American history. The D.C. Sniper attacks took a period of three weeks that began on October 2nd and terminated on October 24th 2002. The two case subjects engaged in a series of shootings in different locations throughout Washington D.C. metropolitan area including District of [City, State] and Virginia. The perpetrators used powerful firearms that would make perfect and successful shootings from a distance. In specific, Muhammad and Malvo used high-powered Bushmaster XM-15 rifle giving them an opportunity to shoot their targets from a concealed position at a distance (Gartenstein-Ross and Trombly, 2012). During the attacks, the two hide in the trunk of a car where they could open the trunk slightly and fire the shots targeting random individuals. Their random targets made it a challenge for law enforcers to predict their next move thus enhancing fear, uncertainty and tension throughout the target areas. Unfortunately, the case victims were ordinary citizens going about their daily chores thus included men, women and worst of all innocent children like Iran Brown who was shot on Monday 7th at around 8.1A.M after alighting his Aunts car in-front of Tasker Middle School, 4901, Collington Rd, [City, State] 20715 (Gov data, 2023). In short, the random targets were shot while walking within the parking lot, to school, from work, while pumping gas or normal routine activities like grocery shopping. After the random attacks, the law enforcement decided to respond to ease the tension and restore hope of a peaceful and habitable environment in the target areas. The Montgomery County police became the main law enforcers at hand with their headquarters as the main recipient of any information be it written or via call relating to the attack. The police noted that the perpetrators targeted the densely populated areas in Washington, well travelled areas and shot during daytime. The law enforcers also noted a single shot in each case that claimed a single victim. Law enforcers asked potential witnesses about the perpetrators with little to no trace of any. Other law enforcers like FBI, Maryland State Police, U.S Marshals Service and Secret Service joined forces in the search of the perpetrators. Muhammad and Mavlo started calling the police department trying to set for negotiations and warning them against releases of their demands to the press which in a way served as a pathway to their capture and arrest . However the main breakthrough in this case happened when a call from Whitney Donahue, a refrigerator repairman around Washington area got the law enforcers some minutes after midnight Thursday 24th October 2002. As Donahue went home “Greencastle”from work when he heard the news about the case subjects through a radio and recorded their car details only to spot it after pulling into his rest area in Maryland. The 911 response bore fruit as the law enforcers found the two perpetrators sleeping in their blue Chevrolet Caprice, arrested them and handed them over to the state police. Although the exact motive of the D.C. Sniper attacks was not established and remains as subject of speculations, the two faced legal proceedings and sentencing with Muhammad sentenced to death while the juvenile received a life imprisonment without possible parole. Explain the criminal statute violated and explain the elements of the criminal acts the defendant was charged with. (See CalCRIM) The D.C. Sniper case subjects faced a range of charges that included murder, attempted murder among other firearms-related offenses. However, it is imperative to note that the criminal statutes violated varied based on charges as well as the jurisdiction through which the subjects were prosecuted. Murder as the primary charge for the D.C. sniper case proved a criminal statute violation. The elements of this crime included the unlawful killing of randomly targeted victims as well as the ill intent to kill or unreasonable disregard for human life. Upon multiple counts, Muhammad and Malvo faced charges of ten counts of murder which required proof based on perpetrators men rea and actus reus during the time of attack. For the victims that survived the attacks, the two perpetrators faced charges of attempted murder as a criminal statute violation. The elements of the attempted murder crime raged from the intent to kill another person, a substantial step towards the commissioning of crime as well as an overt act in furtherance of the aforementioned intent. In all the aforementioned count of attempted murder, the prosecution had a great task of proving beyond reasonable doubt that the defendants intended to commit the crime with defined steps to enhance the success of such intentions. Last but not least Muhammad and Mavlo also violate gun right laws whereby they were charged with illegal possession and misuse of firearms during the attacks. The elements of this crime though depended with the specific charges brought in each circumstance and jurisdiction of each offense revolved around unlawful possession of firearms, misuse of a firearm during crime commissioning as well as the possession of firearm by a convicted felon if applicable.
