Abstract
Article # 1; Detention of people with cognitive disabilities in Australia The atrocities on the Criminal justice systems in Australia is difficult to apprehend. Over one thousand Australians with cognitive disabilities are detained each year indefinitely. Where are our instincts and humanity? The detainees have tasted the bitter reality of human right violations and abuse, yet the government is silent about it. Indeed, these people with cognitive trials cannot stand trial, but should it be indefinite? The unfitness comes with the analogy that they cannot stand trial. These people are not in their sobriety; why should they be detained. Justice delayed is justice denied. The detainees deserve a speedy resolution on their fate not detained without a proper course of action. The perverse criminal Justice System in Australia has gained momentum and intervention from The UN Committee for the Convention on the Rights of People with Disabilities (CRPD) which has seen the adversity of the situation. The Australian courts are not serving justice. Those with disabilities are given an indefinite sentence, while those without disabilities are given a definite release. Where are democracy, justice in courts, and adherence to human rights on their freedoms and equalities? Just like any other human being, those with cognitive disabilities deserve justice. What if the mentally disabled don’t recover or do not respond to medication or stay in courts forever? These people should not be detained based on the indefinite release. The subjects in the court are even traumatizing; human right violation and abuse is persistent; it should stop It is necessary to address justice and fairness in our courts. The detention of persons with cognitive disabilities brings to the limelight what has been trampled on in Australia. It has created awareness on the quest for justice for the disabled. The criminal justice system needs reforms and government intervention. It is a war that needs to be fought with dedication.
