Abstract
Apartment/ Search Warrants [Name] The search warrants enhance crime controls in an excellent manner (Samaha, 222). The power to search allows searches to invade the privacy of individuals, their homes, their private papers and their property. In our case scenario, it is clear that with a search warrant, the search remained fully protected by the Fourth Amendment as the investigator did not use illegal methods to get the evidence. In the current case, the officer applied and secured a search warrant for the entirety of the apartment. Such a warrant implies that the officer has the right to search all rooms within John’s apartment, including David's room within the same apartment. Ignorance of law has no defense. Arguing from the secured search warrant point of view, it is clear that any physical evidence relating to illegal drugs, whether found in Johns or David's room, can remain used as potential evidence against John or David. Unlike searches of complex electronic devices that to some extent violates the doctrine of private search as stipulated by the Fourth Amendment, searches of physical space and the items offer a different perspective that allows for physical evidence gathered beyond the core mission of the investigator to be a potential reason for opening a new case for the defendant (Pg, 67). Under searches for physical spaces like in our case scenario, the law assesses the degree to which such search intrudes upon an individual's privacy and the degree to which it remains needed to promote legitimate government interest. The court should not suppress evidence against David being the physical plant of an illegal drug to this effect.
