Abstract
LEGL 370 Narrative Responses on Prison Overcrowding Should legislators have to conduct analyses of how prison populations might be affected with new laws or changes in punishment for certain offenses as well as what the estimated costs to taxpayers might be? Yes, legislators have a responsibility to conduct thorough analyses of how new laws or changes in sentencing policies might impact prison populations and the associated costs to taxpayers. Basically, the increasing prison admission leading to overcrowding in prisons are significantly triggered by the set crime control policies thus the need for reconsideration of such policies. In real sense, policy effectiveness is the key to a positive change towards the overcrowding state. Understanding the potential impact on prison populations will help legislators assess whether the proposed laws are likely to achieve their intended goals, such as reducing crime or deterring offenders. Through such consideration, the most viable policies will be implemented while doing away with those that are doing more harm than good in regard to prison population. There is also the need to do Cost Considerations. Estimating the financial implications is important for budgeting and fiscal planning. To this effect, taxpayers should be informed about the financial costs associated with changes in criminal justice policies, especially when these changes could lead to increased expenditures on corrections facilities. Lastly, there is the need to consider the Ethical and Social Implications. Overcrowded prisons can lead to numerous negative consequences, including reduced effectiveness of rehabilitation programs, increased violence, and worsened living conditions for inmates. Legislators have a duty to consider these implications when making decisions that affect criminal justice policies to ensure that the set crime control policies foster recidivism than just overcrowding criminals in cells without impacting their criminal character I a positive manner. Do you think that these laws deter future offenders from engaging in certain criminal acts? Yes in a way and to some extent no. Basically, the effectiveness of tough sentencing laws and mandatory minimum statutes in deterring crime is a complex issue. Research findings on deterrence vary, but the consensus suggests that the certainty and swiftness of punishment have a greater deterrent effect than the severity of the punishment alone.
